no, you dont need any patch. APM is builtin in linux 2.2.x.
are you sure that you installed the new kernel as well?
try running dmesg|grep -i apm
root@beep:/home/sagi# dmesg|grep -i apm
apm: BIOS version 1.2 Flags 0x07 (Driver version 1.13)
root@beep:/home/sagi#
