I have no format law expertise, but usually a law can be interpreted,
the simple interpretation of that section in the law will apply ONLY to
faximilie machines as it says specifically that it applies to fax
machines and doesn't refer to computer methods.
However, laws can also be interpreted in a broad way, as long as they
are interpreted "in the spirit of the law", that is to include
everything the law intended to include and not just what it said to
include.
I believe it is said in the referred page that you will need some good
reason to interpret the law in this way, that is, you'll need a good
lawyer :-)
I've also read the privacy law, and there there it says that you cannot
use private information of a person, this means that spam mail cannot be
used, BUT it defines this as a civil offense and there is also a
requirement that it be a "real offense" or the like, that is that there
is some proveable damage. Those unnamed small messages do not fall under
this clause (in my limited law knowledge).
